PrintSpeak Terms and Conditions of Use

This is PrintSpeak, a website (the Site) owned by PrintSpeak Limited and operated by PrintSpeak Limited and its agents (PrintSpeak, We, Us, Our). Your (You, Your) use of the Site is subject to the following Terms & Conditions of Use, which You are deemed to have accepted by using the Site. These Terms & Conditions apply on every occasion that You access the site, on every device that You use to access it, including but not limited to internet browser, PDA, RSS reader and mobile phone.

1. Additional Terms

Additional terms will apply to any transaction that You make through the Site, and also to Our use of Your Registration data (see Our Privacy Policy).

2. Copyright

The copyright and all other rights in the material on this Site are owned by Us or are included with the permission of the owner of the rights. As a user of this Site, You may subject to what is stipulated below download, view, listen to, print or copy onto the hard disk of Your computer (but not photocopy) material from the Site for Your own private, non-commercial usage purposes only; internal business purposes; personal information purposes. Single copies of pages from the Site may be printed out for the sole prupose of enabling the person printing the page to retain a copy for their own personal records. No copying, broadcast or other form of reproduction of the material in this Site is permitted without the prior written consent of PrintSpeak. Subject to this paragraph, all rights in material on the Site are reserved by PrintSpeak.

3. Prohibited Use

You agree not to use this Site:

  • To create a database (electronic or otherwise) that includes material downloaded or otherwise obtained from this Site otherwise than for Your own personal records, and except where expressly permitted on the Site;
  • In any way that is abusive, defamatory or obscene, or that will harass, distress or inconvenience any person or company, or which might restrict or inhibit the use, enjoyment and utility of the Site by any user;
  • To transmit or recirculate any material obtained from this Site to any third party except where expressly permitted on the Site;
  • In such a way as to remove the copyright, brand identity or trade mark notices from any copies of any material on the Site;
  • To disseminate any unsolicited or unauthorised advertising, promotional materials, ‘junk mail’, ‘chain letters’, ‘spam’, ‘pyramid marketing’ or other form of solicitation or commercial exploitation;
  • To disseminate any material that contains software viruses or any other computer code, files or programs that are designed or intended to interrupt, restrict, damage, destroy, limit the functionality or compromise the integrity of any computer software, hardware or telecommunications equipment;
  • In any way that might infringe third-party rights or that might bring Printspeak, or any of its employees, or any of its agents into disrepute;
  • You acknowledge that any breach of the agreements given above may cause PrintSpeak damage or loss and You agree to indemnify PrintSpeak in full and permanently against any third party liabilities, claims, costs, loss or damage that it incurs as a result of publishing material that You submit to it, including consequential losses.

4. Registration


This Clause 4 shall apply where You register with PrintSpeak for use of the Site.

4.1 You agree to provide true, accurate, current and complete information about Yourself as prompted by PrintSpeak in the registration form ("the Registration Data"). You agree to maintain and promptly update the Registration Data to keep it true, accurate, current and complete by sending an appropriately-worded email to fiona@printspeak.co.uk.

4.2 Our use of Registration Data is subject to Our Privacy Policy.

4.3 As part of Your Registered status as a user of this Site, You will be allocated with or will choose a unique username and/or password giving access to Your account. You are responsible for maintaining the confidentiality of Your username and password, and are fully responsible for all activities that occur through Your account. You agree to (a) immediately notify Us if You become aware of any unauthorised use of Your password or website account or any other breach of security by sending an appropriately worded email to fiona@printspeak.co.uk, and (b) ensure that You Sign Out from Your account at the end of each session. We cannot and will not be liable for any loss or damage arising from Your failure to comply with these requirements.

5. User-submitted content

5.1 By sending text, images, audio, video or any other content whatsoever to this Site You accept that the files so sent become the property of PrintSpeak, and that We shall have the right to use that content in perpetuity, throughout the world, in all known, discovered and future mediums, and for all purposes, and We shall have the right to make it available to users on this Site and elsewhere. All material must comply with Our Acceptability policy, set out below. We may require You to confirm the rights granted in this paragraph, and where requested to do so, You shall provide all reasonable assistance to Us.

6. Information

6.1 Whilst We take every care to ensure that the information on the Site is accurate and complete, some of it may be supplied to Us by third parties and We are unable to check its accuracy or completeness. PrintSpeak accepts no liability for any loss, damage or any consequence whatsoever or howsoever arising from any material published on this Site. By using the Site, users agree that they are solely responsible for ensuring that any product or service featured on the Site meets their needs and is fit for their particular purposes and requirements, and for checking the accuracy of material appearing on this Site before entering into any commitment in any part based upon or informed by material appearing on this Site.

6.2 The information on this Site does not necessarily reflect the views and opinions of PrintSpeak Limited, nor of any of its employees nor its agents.

7. Availability

Due to the inherent nature of the Internet, errors, interruptions and delays may occur in the service at any time. Accordingly, this Site is provided on an "as is" and "as available" basis without any warranties of any kind as to continued availability, and We do not accept any liability arising from any interruption in availability.

8. Removal of material and cancellation of access to the Site

8.1 PrintSpeak shall have the right to cancel Your registration and/or refuse You access to the Site at any time and for any reason without giving You any notice. In such cases, PrintSpeak shall not be liable for any losses or damages whatsoever (other than losses or damages for death or physical injury arising out of the negligence of PrintSpeak or its employees) arising from Your inability to access any of the material on the Site.


9. Liability

9.1 Some areas on the Site include material originated by and supplied by third parties, including but not limited to advertisements. Advertisers and other originators are solely responsible for the content of advertising and other material which they submit to PrintSpeak and for ensuring that such content complies with all relevant legislation. PrintSpeak accepts no liability for the content of material posted by third parties whatsoever or howsoever arising, including, without limitation, any error, omission or inaccuracy therein.


9.2 Automatic links to other websites may appear in some areas of the PrintSpeak.co.uk Site. By using this Site, and particularly by clicking on such links, You acknowledge that the owners and operators of such other websites may be independent from Us, and We do not offer endorse or accept any responsibility for their content.

9.3 On some of the pages of the Site users may be given the opportunity of entering into agreements with third parties. PrintSpeak is not a party to those agreements, and does not act as an agent for those third parties (who, in turn, do not act as agents for PrintSpeak) and PrintSpeak is not liable in relation to, and takes no responsibility for, any contract entered into by users with any third party.


10. Computer Viruses


Whilst effort has been taken to ensure that the pages of the Site and any material that may be downloaded from the Site are free from computer viruses or other malicious code, PrintSpeak gives no warranties that they are indeed free from such viruses or malicious code and users are responsible for virus-checking all material downloaded from the Site and maintaining adequate protection against such viruses and other malicious code. We exclude to the fullest extent permitted by law all liability in connection with any damage or loss caused by computer viruses or other malicious code originating in or contracted from the Site.

11. Trade marks


The names, images and logos identifying PrintSpeak or third parties and their products and services, are the proprietary marks of PrintSpeak, and/or may be the proprietary marks of third parties. Any use made of these marks may be an infringement of rights in those marks and PrintSpeak reserves all rights to enforce any rights of ownership or any other rights that it may have.


12. Variations


These terms may be varied from time to time. Please ensure that You review these terms and conditions regularly as You will be deemed to have accepted a variation if You continue to use the Site after any variation has been posted.

13. Objections to material

If You object to the publication of any material anywhere on the Site please let Us know by calling 01904 560514 or by sending an appropriately-worded email to Karen Charlesworth at karen@printspeak.co.uk and We will take whatever action We deem appropriate.

14. Terms & Conditions for Competitions

These rules apply to all prize promotions including free draws, prize competitions and instant win offers. Depending on the nature of the competition there may be additional rules.

  • Promotions are open to UK residents aged 18 and over.
  • Prizes are non-transferable, non-negotiable and no cash alternatives will be offered.
  • PrintSpeak (and the promoter if a third party) reserve the right to substitute the prize for another prize of equal value.
  • NO PURCHASE IS NECESSARY to enter the competitions unless otherwise stated on the promotional activity promoting a specific competition.
  • By entering the prize draw, the entrant agrees to be bound by the rules and by any other requirements set out in any promotional material accompanying the promotion.
  • By entering the promotion, the entrant agrees to these Terms & Conditions of Use and the terms of the Privacy Policy. In addition, PrintSpeak may pass the entrant’s personal information to the promoters and their data processors, where those promoters and their data processors are third parties. We always request that those parties adhere to the same security and data protection procedures that We follow Ourselves, but cannot guarantee that such a request will be honoured by those parties.
  • Winners will be notified by email or telephone on the day of the draw. Winners have five (5) business working days to respond in full to the email or another winner will be drawn.
  • By entering the promotion, the winner(s) consent(s) to any publicity generated as a result of the promotion, and use on this Site at any time.
  • Prize draws are open to all residents of the UK, except employees of PrintSpeak Limited and its agents, paying customers of PrintSpeak Limited (ie, suppliers) and their agents and employees, the promoter and their immediate families, the promoter’s advertising agency and sales promotion consultancy, and anyone else connected with the creation and administration of the promotion.
  • The Site Publisher’s decision is final and no correspondence will be entered into. Odds of winning depend on the number of eligible entries received.
  • PrintSpeak will not accept responsibility for loss through technical fault, incomplete, illegible or other damaged entries. Proof of entry is not automatically proof of receipt.
  • The promotional draw is held by PrintSpeak.
  • A list of prize-winners is available by emailing info@printspeak.co.uk.

15. Severability


If any provision of the Contract is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable it shall to the extent of such illegality, invalidity, voidness, voidability, unenforceability or unreasonableness be deemed severable and the remaining provisions of the Contract and the remainder of such provision shall continue in full force and effect.

16. Jurisdiction


16.1 The Site has been created with UK users in mind and therefore its content may not be appropriate or lawful outside of the UK. Users from outside of the UK should therefore verify for themselves whether or not it is appropriate for them to access the Site



16.2 The terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from matters relating to the Site shall be exclusively subject to the jurisdiction of the courts of England and Wales.
